The Makati Regional Trial Court has dismissed the petition for a writ of habeas corpus filed by rapper Loonie and several others in connection with their arrest over drug charges.
Loonie, or Marlon Peroramas; his sister Idyll Liza Peroramas, David Rizon, Ivan Agustin and Albert Alvarez filed the petition to question their continued detention.
"From the arguments of the parties and the admission in open court, it appears that the petitioners were already subjected to inquest proceedings on September 20, 2019," said Judge Ricardo Moldez II in his order denying the petition.
"This court considers this developmentr as a supervening event, enough to render the instant petition moot and academic," he added.
Moldez said it would be "highly imnpractical" for the court to order the release of the petitioners without preempting any resolution coming from the Office of the City Prosecutor of Makati City."
"This court notes that as of this moement, there is no resolution to speak of," Moldez said.
liptop star Loonie was nabbed during a buy-bust operation in the parking basement of a hotel in Barangay Poblacion, Makati City on Wednesday night.
Arrested along with the rapper, whose real name is Marlon Peroramas, were his sister and three other individuals.
Authorities seized 15 sachets of kush or high-grade marijuana hidden in a box that was made to look like a gift.
The Makati City Police said they had been monitoring Loonie's activities for almost a month before they carried out the buy-bust operation. —NB, GMA News
